He is cleary outside the track during all the climbing and he takes advantage. Pellegrino was DSQ in the past for the same thing in the past season (it was a sprint)

It all depends on what the organisera have decided. Those type of markanta are most often used more to guide the skiiers and they have boards that are used to show where you are not allowed to ski. Sometimes these marks are used also in that purpose as well. So a dsq might be the case depending on the rules for this specific race
